Austria, as a member of the European Union, actively supports and promotes the universality of the Rome Statute of the International Criminal Court and its development.

Austria has assumed the facilitation of the discussion process on the activation of the ICC’s jurisdiction over the crime of aggression and promotes a decision on the activation at the upcoming Assembly of States Parties (ASP) in December 2017. From 2012 to 2016 Austria also facilitated the negotiations on the ICC’s budget.

Since 1 January 2016, the Austrian Penal Code, in addition to the jurisdiction for other international crimes under the Rome Statute, also provides for full complementary jurisdiction of Austrian courts over the crime of Aggression.
